TOP-AC does not collect, store, or control full credit application data or lending decisions made by Wells Fargo. Any financing agreement is entered solely between you and the third-party lender.
We also automatically collect certain technical and usage information when you visit our Site. Enrollment in a membership plan does not guarantee immediate emergency response, uninterrupted HVAC system operation, prevention of mechanical failure, manufacturer warranty coverage, or elimination of repair costs.
HVAC systems may fail due to age, wear, manufacturer defects, improper prior installation, environmental conditions, electrical irregularities, misuse, or unforeseen mechanical breakdown. TOP-AC is not responsible for pre-existing defects, concealed equipment deficiencies, third-party installation errors, acts of nature, natural disasters, power surges, or external property damage. Membership benefits may be modified or updated in accordance with applicable law and company policy.
Participation in a membership program does not create a warranty beyond any written service agreement provided at time of enrollment.
TOP-AC may offer promotional financing for HVAC products and services through Wells Fargo or its affiliated financing entities. Financing is provided solely by the third-party lender and is subject to credit approval. TOP-AC does not act as a lender, creditor, or financial institution.
All credit decisions, loan approvals, interest rates, fees, penalties, promotional terms, and repayment obligations are determined exclusively by the lender. TOP-AC does not guarantee financing approval and is not responsible for denial of credit, changes in promotional terms, interest accrual, billing disputes, account servicing errors, credit reporting actions, late payment consequences, or lender policy changes.
Any dispute relating to financing must be directed to Wells Fargo or the respective finance provider. TOP-AC disclaims liability for any losses, damages, or claims arising from third-party financing agreements.
We may share personal information with trusted service providers who assist in operating our business, including website hosting providers, customer management systems, scheduling software, payment processors, analytics platforms, marketing vendors, and communication service providers.
